General Terms and Conditions (GTC) – Kitchen Installation

1. Scope

These General Terms and Conditions apply to all contracts for kitchen installation services concluded between XLBOX Services GmbH, Berthold-Haupt-Straße 34, 01257 Dresden (hereinafter referred to as "XLBOX") and its customers.
Any differing or supplementary terms and conditions of the customer shall only apply if they have been expressly confirmed in writing by XLBOX.

2. Subject matter of the contract

XLBOX handles the professional installation of fitted kitchens and related components. This includes, among other things, the assembly and screwing together of cabinets, the installation of worktops, sinks, taps, and – depending on the agreement – the connection of electrical and water lines.
The specific scope of services is determined by the respective offer or the individual agreement with the customer.

3. Offer and conclusion of contract

All offers from XLBOX are non-binding. A contract is only formed upon written order confirmation or the actual execution of the installation. Any verbal agreements require written confirmation from XLBOX.

4. Prices and Payment Terms

All prices are in euros and exclude statutory VAT.
Unless otherwise agreed, invoices are payable within 14 days of the invoice date without deduction.
In case of late payment, XLBOX reserves the right to charge default interest in accordance with § 288 BGB as well as a reminder fee.

5. Cancellation by the customer

Free cancellation is possible up to 7 calendar days before the agreed installation date.
For later cancellations, XLBOX charges a processing fee of 40% of the agreed order value.
If the installation is cancelled on the day of execution or cannot be carried out (e.g. due to lack of access), the full amount will be due.

6. Customer's duty to cooperate

The customer undertakes to ensure that the kitchen and all elements to be installed are complete, functional and ready on the day of installation.
In addition, functioning electricity, water and, if applicable, gas connections are required at the deployment site.
Any structural features (e.g. sloping walls, uneven floors) must be communicated to XLBOX in advance.

7. Liability

XLBOX is liable for damages only in cases of intent or gross negligence.
No liability is accepted for damage caused by unsuitable premises, faulty customer parts or undisclosed structural defects.
If any obvious defects are discovered during installation, these must be reported in writing no later than 24 hours after installation.

8. Connection work

If the connection of water or electrical appliances is commissioned, this will be carried out according to generally accepted engineering standards.
XLBOX accepts no responsibility for old devices or defective customer accessories (e.g., defective fittings, unsuitable device connections).

9. Warranty

The statutory warranty period is 24 months.
Defects resulting from improper use, further processing or subsequent modifications are not covered by the warranty.

10. Data protection

Personal data is processed in accordance with the General Data Protection Regulation (GDPR) and the XLBOX privacy policy.
Customers can request information about their stored data at any time.

11. Final Provisions

German law applies. The place of jurisdiction is Dresden, provided the customer is a merchant or a legal entity under public law.
Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. The invalid clause shall be replaced by a provision that most closely approximates its intended economic purpose.
